1.    This DFAT Transparency Portal (Portal) is operated by the Commonwealth of Australia, represented by the Department of Foreign Affairs and Trade (DFAT).

2.    The Portal provides detailed information on Official Development Assistance (ODA) provided by Australia. The aims of the Portal are to:
(a)    improve transparency of ODA data;

(b)    provide ODA financial and performance data for users, including the Australian public, researchers and aid recipients; and

(c)    make ODA information available in a format that is easy to access and understand.

3.    The following terms apply to use of the Portal:

(a)    these terms (Portal Terms); and

(b)    the following terms on DFAT’s website (DFAT Terms):

        (i)      Accessibility;

        (ii)     Freedom of Information; and

        (iii)    Vulnerability Disclosure Policy.

4.    In the event of an inconsistency between these Portal Terms and the DFAT Terms, the Portal Terms prevail to the extent of the inconsistency.

6.    Disclaimer:

(a)    While DFAT takes reasonable care in operating this Portal, including when compiling and displaying data, information displayed on the Portal comes from a range of sources including the International Aid Transparency Initiative, the OECD and from organisations contracted by DFAT to help deliver Australia’s aid program.

(b)    DFAT does not guarantee, and accepts no legal liability whatsoever arising from or connected to, the accuracy, reliability, currency or completeness of any material contained on this Portal or on any linked site.

(c)    Links. The Portal contains links to other websites that are external to DFAT. DFAT has no direct control over the content of the linked sites, or the changes that may occur to the content on those sites. DFAT is not responsible for the content or reliability of links, or for any loss or inconvenience arising from their use. Providing links to external websites does not constitute an endorsement or a recommendation of any material on those sites or of any third-party products or services offered by, from or through those sites. Users of links provided by this Portal are responsible for being aware of which organisation is hosting the website they visit.

(d)    Security. DFAT applies a range of security controls to protect the Portal from unauthorised access. However, users should be aware that the internet is an insecure public network that gives rise to a potential risk that a user's transactions are being viewed, intercepted or modified by third parties or that files which the user downloads may contain computer viruses, disabling codes, worms or other devices or defects.

(e)    DFAT does not warrant or represent that the material on the Portal will not cause damage, or is free from any computer virus or any other defects or errors. DFAT accepts no liability for any interference with or damage to a user's computer system, software or data occurring in connection with or relating to this Portal or its use. Users are encouraged to take appropriate and adequate precautions to ensure that whatever is selected or downloaded from this Portal is free of viruses or other contamination that may interfere with or damage the user's computer system, software or data.

(f)    DFAT is not liable to users of material on the Portal for any loss or damage however caused resulting from use of the materials.

7.    Intellectual property rights:

(a)    With the exception of the Commonwealth Coat of Arms, or where otherwise noted, all material presented on the Portal is provided under a Creative Commons Attribution 4.0 licence (https://creativecommons.org/licenses/by/4.0/ ). The details of the relevant licence conditions are available on the Creative Commons websites (accessible using the links provided), as is the full legal code for the CC BY 4.0 licence (https://creativecommons.org/licenses/by/4.0/legalcode.en). Material from the Portal should be attributed as:

(b)    The terms under which the Commonwealth Coat of Arms may be used are on the Department of Prime Minister and Cabinet’s website.

 8.    Privacy:

(a)    The Portal does not collect or handle personal information.

(b)    ODA information on the portal does not contain personal information.

(c)    You may use the Portal without identifying yourself, unless you choose to identify yourself as part of providing feedback on the Portal. 

9.    Freedom of Information:

(a)    The Portal contains a wide range of documents related to ODA provided by Australia, and is designed to improve transparency of ODA data and make ODA information available in a format that is easy to access and understand.

(b)    Members of the public seeking access to other documents that may be held by DFAT should lodge a formal Freedom of Information (FOI) application. Further information on lodging an FOI application can be found on the DFAT website.

10.    Vulnerability Disclosure Policy:

(a)    If you think you have found a potential ICT vulnerability in the Portal, please tell us as quickly as possible.

(b)    Contact details for reporting vulnerabilities can be found in the DFAT Vulnerability Disclosure Policy available on the DFAT website.
